Introduction & Purpose

This is the Privacy Policy of Ashlee Tabrett (ABN 38 820 503 304), naturopath, Massage and Beauty therapist.  

I am committed to protecting your privacy, whether you are a contact, client, customer or supplier of mine. I am also committed to complying with the Australian Privacy Act 1988 (Cth) and the Australian privacy principles (the Privacy Act and Principles).  

The purpose of this policy is to explain how your personal information (which may include your health information) is collected and used by me in my clinic or through my website and mobile applications (Site).

Please read this policy carefully. By providing your personal information to me, you consent to me collecting, holding, using and sharing your personal information in accordance with this policy.

What personal information do I collect?

The personal information I collect may include:

  • personal details such as your name, date of birth, age, gender, occupation or job title;

  • contact details such as your addresses, postcode, email addresses, mobile and landline phone numbers and fax numbers;

  • your health and lifestyle information including previous and current health and medical history, medications or current treatments, social history, family history and risk factors;

  • your payment information (e.g. your credit card details);

  • details of the products and services you have enquired about or purchased from me, together with any additional information needed to respond to your enquiries and deliver those products and services;

  • your browser session and geo-location data, device and network information, statistics on page views and sessions, acquisition sources, search queries and/or browsing behaviour;

  • information about your access and use of the Site, including through the use of Internet cookies, your communications with the Site, the type of browser you are using, the type of operating system you are using and the domain name of your Internet service provider;

  • additional personal information that you provide to me, directly or indirectly, through your use of my Site, associated applications, associated social media platforms and/or accounts from which you permit us to collect information; and

  • any other personal information requested by me and/or provided by you or a third party during our communications.

How do I collect your personal information?

I may collect your personal information in several different ways including when,

  1. you purchase a product or service from me, including when you make a booking and during consultations;

  2. you subscribe to my newsletter or updates service;

  3. you attend a workshop or event where I am hosting or presenting;

  4. you correspond with me on a social media platforms such as Facebook, LinkedIn, Instagram or similar sites;

  5. you contact me with a question, comment or inquiry;

  6. you provide information relating to your business; or

  7. you visit my website.

Where reasonable, I will collect personal information directly from you. However in some circumstances (for example, when  it is not practical or reasonable to collect directly from you, or where you have authorised me to do so) personal information may also be collected from other sources, such as:

  1. your guardian or responsible person (if under 18); and

  2. other involved healthcare providers, such as specialists, allied health professionals, hospitals, community health services and pathology and diagnostic imaging services.

If you do not provide me with personal information when requested to do so, I may not be able to carry out your instructions or achieve the purpose for which the information has been sought.

Wherever lawful and practical, you will have the option of not identifying yourself when dealing with me.

Cookies

I may use cookies on my Site from time to time. Cookies are text files placed in your computer’s browser to store your preferences. Cookies, by themselves, do not tell us your email address or other personally identifiable information. However, they help with things like site navigation and user-friendliness. They also tell me which products or services you view so that, if you consent, I can send you news about those products or services.  I also use cookies to see traffic patterns, which areas of my website are visited most or least, and then improve my online products and services. If and when you choose to provide my Site with personal information, this information may be linked to the data stored in the cookie.

The majority of web browsers accept cookies automatically.  You can disable cookies, but it might restrict your ability to access certain areas of the Site.

Why do I collect, use, hold and share your personal information?

I may collect, hold, use and disclose personal information for the following purposes:

  • to contact and communicate with you;

  • for internal record keeping and administrative purposes;

  • to provide you with my products and services, including to provide personalised treatment plans and recommendations to you;

  • for analytics, market research and business development, including to operate and improve my Site, associated applications and associated social media platforms;

  • to evaluate, modify and enhance my products and services, including to develop new products and services;

  • to enable you to access and use the Site, associated applications and associated social media platforms; and

  • to run competitions and/or offer additional benefits to you;

  • for advertising and marketing, including to send you promotional information about my products and services and information about third parties that I consider may be of interest to you;

  • to comply with my legal obligations and resolve any disputes that I may have; and

  • to consider your employment application; and

  • to otherwise operate and administer my organisation.

Who do I share your personal information with?

I may share your personal information with:

  • third party service providers to enable them to provide their services, including (without limitation), IT service providers, data storage, web-hosting and server providers, debt collectors, maintenance or problem-solving providers, marketing or advertising providers, professional advisors and payment systems operators;

  • my employees, contractors and/or related entities;

  • my existing or potential agents or business partners;

  • sponsors or promoters of any competition I run;

  • anyone to whom my business or assets (or any part of them) are, or may (in good faith) be, transferred;

  • credit reporting agencies, courts, tribunals and regulatory authorities, in the event you fail to pay for goods or services I have provided to you;

  • courts, tribunals, regulatory authorities and law enforcement officers, as required by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend my legal rights;

  • third parties, including agents or sub-contractors, who assist us in providing information, products, services or direct marketing to you. This may include parties located, or that store data, outside of Australia, including USA.

  • third parties to collect and process data, such as Google Analytics. This may include parties that store data outside of Australia.

  • when it is necessary to lessen or prevent a serious threat to a patient’s life, health or safety or public health or safety;

  • when you are unable to act on your own behalf due to a health condition, I may need to discuss your health information with relatives or emergency contacts, in order that you are provided with appropriate care;

  • to assist in locating a missing person;

  • when there is a statutory requirement to share certain personal information (e.g. some diseases require mandatory notification);

Disclosure of information outside Australia

I will use all reasonable means to protect the confidentiality of your personal information while in my possession or control. To the extent that I do share your personal information with a third party, I will request that party comply with the privacy standards as described in this privacy policy. However, some of my service providers may be overseas and may not be subject to the Privacy Act and Principles.

Communications and marketing

I may from time to time use your personal information in order to communicate and market my products and services to you via newsletters, email invitations and updates about my services. You may opt out of direct marketing at any time by notifying us in writing or by using the opt-out facilities provided in the communication.

How do I store and protect your personal information?

I am committed to ensuring that the personal information I collect from you is stored safely and securely.  As such, I have put in place reasonable physical, electronic and administrative procedures to safeguard and secure your personal information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

For example, I maintain my files in secure offices and limit access to personal information to individuals with a need to know. I do use cloud storage for personal information with Simple Clinic and G-Suite. These companies are subject to encryption and protection that can be found on their websites. If you are in communication with me via electronic means such as email, Zoom, contact forms, Instagram or Facebook, I do not have full control over the transmission or storage or any personal information disclosed. You agree that by participating in such forms of communication you understand and accept that there is an inherent risk of disclosure or loss of your personal information for which I cannot be held responsible.

I will destroy or de-identify personal information I no longer require except where I have a legal obligation to retain such information, such as your health information. I will never permanently store complete credit card details.

Privacy and my website

Please note given my website is linked to the internet, and the internet is inherently insecure, I cannot provide any assurance regarding the secure transmission of information you communicate to me online.  Similarly, I cannot guarantee that information you supply will not be intercepted during its transmission over the internet. Because of this, any information you send to me online is at your own risk. Although I take measures to safeguard against unauthorised disclosures of information, I cannot assure you that the personal information I collect will not be disclosed in a manner that is inconsistent with this policy.

My Site may contain links to other websites operated by third parties. I do not have any control over those websites, and I am not responsible for the protection and privacy of any personal information which you provide whilst visiting those websites. I note those websites are not governed by this policy.

How can you access and correct your personal information?

You may request details of the personal information that I hold about you.  An administrative fee may be payable for the provision of such information.  In certain circumstances, as set out in the Privacy Act 1988 (Cth), I may refuse to provide you with personal information that I hold about you.

I will take reasonable steps to correct your personal information where the information is not accurate, complete or up to date. From time to time, I may ask you to verify that your personal information held by me is correct and current. You may also request that I correct or update your information, and you should make such requests in writing to: ashlee@ashleetabrett.com

How can you lodge a privacy-related complaint?

I take complaints and concerns regarding privacy seriously. You should express any privacy concerns you may have in writing. I will then attempt to resolve it within 30 days. Any complaints should be sent directly to me at: ashlee@ashleetabrett.com

If you are not satisfied with my response, you may also contact the Office of the Australian Information Commissioner (OAIC). Generally, the OAIC will require you to give them time to respond before they will investigate. For further information visit www.oaic.gov.au or call the OAIC on 1300 363 992.

Changes to my policy

I may modify this privacy policy from time to time. I will post my updated policy on my website. I recommend you check my website regularly to ensure you are aware of my current Privacy Policy.

Cancellation Policy

Please be advised that cancellations made up to 48 hours before a scheduled appointment via email, text, phone call will be processed without a penalty.

Cancellations made 48 hours or less before an appointment will be subject to a charge of half of the service rate. This includes appointments where our service provider is unable to access the property, is turned away, or the client is unavailable.

If Ashlee Tabrett cancels an appointment with less than 48 hours notice, a new appointment will be scheduled without penalty to the client, subject to availability.

Delivery

The Price does not include delivery and freight costs to the nominated delivery address of the Customer, unless specifically provided for in the description of the Goods. Ashlee Tabrett can provide the Customer with a quotation in this regard upon request.

Unless agreed otherwise in writing prior to delivery, unloading of Goods shall be the Customer’s responsibility and the company will not be responsible for any damage resulting from the unloading of the Goods by the Customer or by anyone on its behalf, or by Ashlee Tabrett, employee or agent. The Customer indemnifies Ashlee Tabrett for any claim whatsoever resulting from the customer, its employee or agent loading goods supplied by the Company on any vehicle or unloading Goods supplied by Ashlee Tabrett from any vehicle.

A quantity, description, date, time and place of delivery as shown on the Company’s (Ashlee Tabrett) invoice or delivery docket shall be conclusive evidence of quantity, description, date, time and place of delivery of such Goods.

Returns Policy

Your satisfaction with the products we supply and our service is important to us.  As such, we do accept product returns under the following conditions:

  1. The product you receive is faulty. Note: Change in taste or appearance does not always mean the product is faulty and will be managed on a case by case basis.

  2. You receive a product that has been damaged during transit.

  3. You receive a product that was not what you ordered. - if the order was placed through the website, patient portal or via email.

In order for a refund or credit to be issued, the following terms must be met

Faulty/Damaged Product

Where a product is believed to be faulty, is damaged in transit or does not meet our strict quality standards, a Product Return/Credit Application must be completed.  This form can be found here.  Any faulty goods must be notified to the company within 7 days of receipt.  Photos must be attached to the return application. Please retain products in case they are required to be returned to the company for further examination.

Discrepancies Between Products Ordered and Products Supplied

Any discrepancies between goods ordered and goods received must be notified to the company within 48 hours of receipt.  All items must be receipted in their original condition. Credit notes or refunds are not able to be processed until the products have been receipted back into the warehouse. 

Incorrect Product Ordered by Accident

Any products ordered incorrectly and requiring refund/exchange will need to be returned to Ashlee Tabrett within 7 days of receipt in a resalable condition. Returned products that are damaged during transit will not be replaced or refunded if packaged inadequately.  The company must be notified and all product returns must be accompanied by an RMA slip issued upon approval by the company. Credit notes or refunds are not able to be processed until the products have been receipted back into the warehouse. All items must be receipted in their original condition and freight is at the expense of the customer

If a phone order has been placed, all orders are read back to the client and confirmed. If you then receive the order and there are incorrect items in the order the freight for the return of the is at the customer's expense.

A refund or replacement will not be provided if:

  1. You have opened the product.

  2. The products are sent back to us and are damaged during transit, price tags or markings. You must adequately package any goods you are returning to us

  3. There has been a change of mind.

  4. They are not working as intended - this includes disliking the flavour.

  5. There is an error made by the customer if the wrong address was given - including website orders. (always double check sending address before finalizing order)

  6. Customers who choose to "leave the parcel if no one is home" and the parcel is not received/goes missing. To avoid this please note on the order you do not want an Authority to leave. - please note if you are not at the residence at the time of delivery, the order will be taken to the nearest POST OFFICE or COURIER OFFICE and you will be required to collect

  7. No temperature sensitive products can be returned even if the product arrives warm - all temperature sensitive items are packed with an icepack and shipped via cold storage. If you require stability data please contact our office and we are more than happy to email through to you.

  8. Liquid Dispensary including bespoke herbs, creams, mists and lotion items are a special made order item therefore are non-refundable

  9. The customer has provided the incorrect shipment address and products have been successfully delivered to the incorrect address.

Supply Only: The Price is for the supply of goods only and does not include any service fees, commissioning, staff training or any other services for the Goods supplied. The risk and obligation to be properly trained and qualified in the use of the Goods supplied by the Company rests on the Customer.

Cancellations: Once an order for Goods has been accepted by the Company, the Customer can only cancel, vary or suspend the order (whether in whole or in part) upon the following conditions:-

  1. the Company agrees in writing to the request of the Customer;

  2. no cancellation, variation or suspension will be effective or recognized unless, and only to the extent, that the Company agrees in writing to such cancellation, variation or suspension.

  3. the Customer agrees to accept delivery of any Goods held by and all goods in transit to the Company in respect of such order which are non-returnable to the supplier or may not be saleable to other parties; and

  4. the Customer agrees to pay all costs, expenses and liabilities incurred by the Company in consequence of the cancellation, variation or suspension of the order and accepts any fees proposed to be charged by the Company as a result of such cancellation, variation or suspension of the order.

Retention of Title: Until such time as payment in full has been received by the Company in cleared funds, title in the Goods shall remain in the Company. The risk in the goods passes to the Customer on delivery to the Customer or into custody on the Customer's behalf provided that if the Customer fails to accept delivery or requests a delay in delivery, risks to the Goods will be borne by the Customer from the time of such failure or request (as the case may be) and the Customer indemnifies the Company from any claim, loss or expense whatsoever arising from the Customer's failure or request.

Intellectual Property: 

The Customer acknowledges that Ashlee Tabrett is the owner and holds all rights, title and interest in the various patents, inventions, designs, copyright, trademarks, trade names, business names, corporate names, logos, get up, circuit layouts, know how, trade secrets and confidential information held by Ashlee Tabrett. The Customer will not attempt to seek or claim any interest in Ashlee Tabrett IP, or assist any other party to assert any interest in the Ashlee Tabrett IP. The Customer acknowledges that any improvement or enhancement of the Ashlee Tabrett IP which may result from work performed by the Customer shall remain the exclusive property of Ashlee Tabrett and the Customer irrevocably assigns to Ashlee Tabrett all right, title and interest the Customer may have in any improvements or enhancements, to Ashlee Tabrett IP. The Customer will not hinder Ashlee Tabrett in any application or other measure taken by Ashlee Tabrett to protect or exploit improvements to the Ashlee Tabrett IP.

Assumption of Risk and Release of Liability

1.     The purpose of naturopathic counselling is to improve the overall health, vitality and well-being of the body through nutritional education and the use of natural foods and non-medicinal nutritional and herbal supplements. The Mrs Ashlee L Tabrett, does not diagnose diseases, disorders or conditions.  

2.     The Mrs Ashlee L Tabrett, is not a licensed Dietitian, Doctor or Medical Physician.  

3. As part of the Naturopathic Services, I may be asked to provide information concerning my physical habits, medical history, moods, energy levels, likes and dislikes, lifestyle and diet. This information is collected to enable the Mrs Ashlee L Tabrett to: (i) assess my knowledge of nutrition, (ii) education me about the benefits of sound Naturopathic practices and (iii) recommend dietary changes to improve my general health, vitality and overall well-being. The MrsAshlee L Tabrett will hold this information in confidence and will not release or disclose this information to any other person, without my prior consent, except as required by applicable law.  

4.     If the MrsAshlee L Tabrett, suspects the existence of disease, disorder or condition, I will be informed of this suspicion. However, I acknowledge this is not a diagnosis or conclusion about the state of my health and that I am directed to promptly consult a licensed Physician about any suspected problems.  

5.     Should I request the MrsAshlee L Tabrett, to recommend dietary changes and/or supplements to enhance my body’s natural ability to resist and/or overcome a known disease, disorder or condition, it is my responsibility to disclose the nature of the disease, disorder or condition and all other relevant details to the MrsAshlee L Tabrett. If I have not previously consulted a licensed Physician about this disease, disorder or condition, I acknowledge that I am directed to promptly do so. I am not to alter or discontinue treatments prescribed by a licensed Naturopath, Physician or other licensed health professional without consulting the individual who prescribed the treatment.  

6.     In providing Naturopathic Services to me, the MrsAshlee L Tabrett, is relying upon the truth, accuracy and completeness of all information I have provided to her. Any recommendations I follow for changes in diet, including the use of nutritional supplements, are entirely my responsibility.  

7.     Ashlee L Tabrett is in no way liable for my health or safety.  

8.     In consideration of my participation in the Naturopathic Services, I hereby accept all risk to my health, including injury or death that may result from such participation and I hereby release the MrsAshlee L Tabrett, on my behalf and on behalf of my personal representatives, estate, heirs, next of kin, and assigns from any and all costs, claims, causes of action and damages arising from any and all illness or injury to my person, including my death, that may result from or occur as a result of my participation in the Naturopathic Counselling Services, whether caused by negligence or otherwise.  

9.     48 hours is required for cancelling appointments. Appointments cancelled within 48 hours of your appointment time, you will be billed at 50%.   If you fail to hold a scheduled appointment this includes appointments where our service provider is unable to access the property, is turned away, or the client is unavailable. You will be billed at 100%.

10.     I understand that any therapies I undertake at Ashlee Tabrett are undertaken of my own free will. I accept that the ultimate responsibility for my health care is my own and that Ashlee Tabrett is here to support me in this. I understand that my practitioner reserves the right to determine which cases fall outside their scope of practice, in which event an appropriate referral will be recommended. I hereby agree to assume full responsibility for any manner of loss, injury, claim or damage whatsoever, known or unknown, incurred as a result of same and I, my heirs, executors, administrators or assigns for any loss, injury, claim or damage sustained as a result of my attendance and/or participation. I have read the above release and waiver of liability, and fully understand its contents and voluntarily agree to the terms and conditions stated. I HAVE CAREFULLY READ THIS AGREEMENT AND AGREE TO THE TERMS OUTLINED ABOVE. I UNDERSTAND THIS AGREEMENT TO BE A FULL AND FINAL RELEASE OF ALL COSTS, CLAIMS, CAUSES OF ACTION AND DAMAGES OF ANY KIND ARISING FROM OR IN CONNECTION WITH THE NATUROPATHIC SERVICES.   

Disclaimer of Liability

Ashlee L Tabrett is not a physician or psychologist, and the scope of his/her consultation services does not include treatment or diagnosis of specific illnesses or disorders. If I, the client, suspect I may have an ailment or illness that may require medical attention, then it is my responsibility to consult with a licensed physician immediately. Only a licensed physician can prescribe drugs. 

Any mention of drugs in the course of consultation is only for the purpose of providing a complete history of drugs that the client is taking and not for Ashlee L Tabrett to judge the appropriateness of the medication. Any change in prescription or dosage is a decision the client makes with his or her physician.

Rather than dealing with treatment of disease, Ashlee L Tabrett focuses on wellness and prevention of illness through the use of non-toxic, natural nutritional therapies to achieve optimal health. As a certified clinical nutritionist and functional medicine specialist, Ashlee L Tabrett primarily educates and motivates clients to assume more personal responsibility for their health by adopting a healthy attitude, lifestyle, and diet.

While people generally experience greater health and wellness as a result of embracing a healthier attitude, lifestyle, and diet, Ashlee L Tabrett does not promise or guarantee protection from future illness.

By submitting the form, I acknowledge that I understand that Ashlee L Tabrett is a Mrs and not a physician, and that I should see a doctor if I think I have a medical condition. Ashlee L Tabrett will not be held liable for failure to diagnose or treat an illness, nor will she/he be liable for failure to prevent future illness.

In addition, I have given Ashlee L Tabrett a complete and accurate account of any medical conditions that I may have and any medications that I am taking.
